How to Evict a Tenant - Legal Procedures and Tips

  The landlord must first issue an early termination notice or end of agreement notice to the tenant requesting them to vacate the premises, which should be sent by registered post. If the tenant fails to vacate the premises, the landlord can approach the Rent Court or the Rent Authority seeking eviction.

The Rent Authority in Tamil Nadu is the RDO (Revenue Divisional Officer). The Rent Court or the RDO will call both the landlord and the tenant for an enquiry and then stipulate a deadline for the tenant to vacate the premises. If the tenant still does not vacate, the landlord can approach the RDO for eviction, and the RDO can use police or his authorities to evict the tenant.

The entire eviction process can take up to 90 days, as per the law. However, if either the landlord or the tenant is a senior citizen, the law requires a judgement to be issued within 30 days. Additionally, the landlord can seek double the rent from the tenant for not vacating the premises after the notice or the end of the agreement period.
